HONORAIRES

Dans la plupart des mission de conseil, les honoraires sont calculés en fonction du temps consacré à la mission et sur la base d’un taux horaire.

Le taux horaire peut varier selon la nature et la difficulté du dossier, ainsi que de l’urgence avec laquelle l’intervention est nécessitée.

Dans des cas spécifiques, et bien entendu uniquement avec l’accord du client, il est possible d’appliquer un honoraire de résultat qui ne peut être qu’un complément et ne peut en aucun cas se substituer à l’honoraire principal; la méthode du seul honoraire de résultat (succes fees) étant interdite en France.

Les honoraires peuvent dans d’autres cas être définis selon la méthode du forfait, plus particulièrement pour des missions clairement définies et entièrement prévisibles dans leur étendue et comportant en cela peu d’aléa.

Outre les honoraires, nous portons en compte au client nos frais et les débours.

Par une “convention d’honoraires” (lettre comportant une proposition de services qui une fois acceptée par le client vaut contrat) conforme aux règles du Barreau de Paris, nous communiquons à nos clients le taux horaire et la méthode de calcul des frais à l’ouverture du dossier.

Les débours sont des frais que l’avocat doit exposer pour le compte de son client (frais d’huissier, de greffe, d’experts, de traduction, de déplacement, de logement, d’envois recommandés ou par porteur, etc.). Ils sont portés en compte au client à prix coûtant.

Les notes d’honoraires, de frais et de débours sont payables au comptant, c’est-à-dire à réception. La réglementation relative à la lutte contre les retards de paiement dans les transactions commerciales est applicables aux honoraires, frais et débours.

Des demandes de provision peuvent régulièrement être adressées au client pour constituer une couverture des honoraires prévisibles tout au long du traitement du dossier. Le règlement de la première provision constitue un préalable absolu à l’acceptation du dossier.
